For the purposes of the following conditions, the term “Passenger” is defined as a customer who has solicited Friend of the Family Services LLC for the purpose of providing a Driver for transportation purposes.
1. Driver Use and Permission
- Permissive Use: Passenger allows Friend of the Family Services LLC ’s Drivers to drive the Passenger’s Vehicle for the purposes set forth in these Terms.
- Driver Authorization: Passenger represents and warrants that they are authorized, without restriction, notice, consent, or permission, to request the Services and to allow the Friend of the Family Services LLC Drivers to operate the Passenger Vehicle.
- Vehicle Ownership: Passenger warrants that they are the rightful owner or lessee, as applicable, of the Passenger Vehicle.
2. Insurance Coverage
- Primary Coverage: Passenger agrees that the Driver’s use of the Passenger Vehicle is a “Permissive Use” that is covered under the Passenger’s insurance policy.
- Policy Status: Passenger warrants that their automobile insurance provides property damage, collision, and comprehensive coverage, and that such policies are in full force and effect at the time of service.
- No Restrictions: Passenger warrants that there are no driver restrictions in Passenger’s insurance policies.
- Current Documents: Passenger warrants that the vehicle's registration and insurance are current, and a copy of the registration and insurance certificate will be in the vehicle.
3. Passenger Behavior and Legal Compliance
- Legal Compliance: Passenger agrees to obey all civil and criminal laws, including but not limited to seat belt and open container laws.
- No Contraband: Passenger warrants that no contraband, illegal substances, or items unfit for public transport (including firearms, weapons, explosives, alcohol, drugs, or stolen property) are inside the vehicle.
4. Vehicle Condition and Maintenance
- Working Condition: Passenger warrants that the vehicle is maintained in good working condition, complies with laws, and has no defects making it unsafe to drive.
- Fuel Requirements: Passenger warrants that the vehicle will have sufficient fuel to reach the designated drop-off location.
5. Fees and Trip Expenses
- Travel Expenses: Passenger agrees to pay any expenses required to get the vehicle safely to the drop-off location. This includes tolls and parking fees.
- Fuel Costs: Passenger agrees to pay fuel costs if any Driver concludes the vehicle has insufficient fuel to reach the destination.
- Emergency Expenses: Passenger agrees to pay for towing or other emergency roadside expenses resulting from mechanical failure.
6. Emergency Medical Procedures
- Medical Care: Passenger allows Friend of the Family Services LLC or the Driver to seek emergency medical care if the Passenger or any other rider is injured or becomes ill.
- Vehicle Placement: Passenger allows the Driver to leave the vehicle locked and parked in a hospital or urgent care lot during an emergency. Keys will be held by the Driver until released by the Passenger or an authorized family member.
- Emergency Contact: Passenger allows Friend of the Family Services LLC or the Driver to contact the emergency contact person identified by the Passenger.
7. Cancellation Policy
- Cancellations made within 48 hours of scheduled time of service (with the exception of flights delayed/cancelled by an airline) will incur a $100 cancellation fee payable to Friend of the Family LLC.
